Terms of Service

These terms are the agreement between you and TabulateNow for use of the TabulateNow app and its services. By downloading or using the app, you accept them. If you do not accept them, do not use the app.

1. Who may use TabulateNow

You must be at least 18 years old and able to enter a contract. If you use the app on behalf of a business, you confirm you are authorised to accept these terms for it, and "you" means that business.

2. Your account

You are responsible for your account credentials and for what happens under your account. Tell us promptly if you believe someone else has access. If you invite other people to a store you own, you are responsible for what they do in it.

3. Subscriptions, trials, and billing

TabulateNow requires an active subscription. Subscriptions are sold through the Apple App Store, and Apple's terms govern the transaction.

• The current price, term, and any free trial are shown in the app before you buy, and are charged to your Apple ID.
• Subscriptions renew automatically at the end of each term unless you turn off renewal at least 24 hours beforehand.
• If a free trial is offered and you subscribe during it, the paid term begins when the trial ends unless you cancel first.
• Manage or cancel your subscription in your Apple ID subscription settings. Cancelling stops future renewals; the current term runs to its end.
• Refunds are handled by Apple under its policies. We cannot issue them on Apple's behalf.
• We may change prices or plans for future terms, with notice before the change applies to you.

4. Your data belongs to you

The records you enter and the data synced into your account remain yours. You grant us only the permission we need to run the service: storing, processing, transmitting, and displaying your data to you and to the people you share a store with. We do not claim ownership of it and we do not use it to train machine learning models. Our handling of personal information is described in our Privacy Policy.

You are responsible for keeping your own copies of anything you need to retain. The app's export feature exists for exactly that.

5. Acceptable use

You agree not to:

• break the law, infringe anyone's rights, or use the app to record or facilitate fraud;
• upload other people's personal information beyond what the app asks for, or anything you have no right to share;
• reverse engineer, decompile, or attempt to extract our source code, except where the law expressly permits it;
• probe, overload, or interfere with our systems, or circumvent quotas, rate limits, or access controls;
• resell, sublicense, or provide the app as a service to third parties;
• use automated means to extract data from the service other than through features we provide.

6. eBay and other third-party services

Connecting an eBay account is optional. When you do, you authorise us to retrieve your selling data on your behalf, and your use of eBay remains subject to eBay's own terms. TabulateNow reads from eBay; it does not create, edit, or end your listings. We are not responsible for third-party services, for their availability, or for the accuracy of the data they report, and access can be changed or withdrawn by them at any time. TabulateNow is not affiliated with, endorsed by, or sponsored by eBay Inc.

7. Availability and changes

We work to keep the service available but do not promise uninterrupted operation. We may add, change, or remove features, and we may suspend the service for maintenance. If we discontinue the service entirely, we will give reasonable notice so you can export your data.

8. No tax, accounting, or legal advice

TabulateNow is a record-keeping tool. Its summaries, profit figures, mileage totals, and exports are generated from the data you and your connected accounts supply, and are provided for your own use. They are not tax, accounting, or legal advice, and they are not a substitute for a qualified professional. You are responsible for reviewing your figures and for the returns and filings you make. We do not warrant that any calculation, category, or export satisfies the requirements of any tax authority.

9. Intellectual property

The app, its name, logo, design, and software are ours and are protected by intellectual property law. These terms grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the app while your subscription is active. Nothing else is granted.

10. Feedback

If you send us ideas or suggestions, we may use them without obligation or compensation. You are not required to send us anything.

11. Suspension and termination

You can stop using the app at any time and delete your account from Settings. We may suspend or terminate your access if you materially breach these terms, if your subscription lapses, or if we must do so by law. Deleting your account permanently removes your data as described in the Privacy Policy.

12. Disclaimer of warranties

To the fullest extent the law allows, the app is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the app will be error-free, that data will always sync, or that results will be accurate or complete.

13. Limitation of liability

To the fullest extent the law allows, TabulateNow will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption, however caused. Our total liability arising out of or relating to these terms or the app will not exceed the greater of the amount you paid us in the 12 months before the claim arose, or fifty US dollars. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.

14. Indemnity

You agree to indemnify and hold TabulateNow harmless from claims, losses, and expenses arising from your use of the app, your data, or your breach of these terms, except to the extent caused by us.

15. Apple

These terms are between you and TabulateNow, not Apple. Apple has no obligation to provide support or maintenance for the app. Apple is not responsible for the app or for any claim relating to it, including product liability, legal compliance, or intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

16. Governing law and disputes

These terms are governed by the laws of the State of [STATE], United States, without regard to its conflict of laws rules. You and we agree to the exclusive jurisdiction of the state and federal courts located there, except that either party may seek injunctive relief where necessary. Nothing here removes any mandatory consumer protection rights you have where you live.

17. Changes to these terms

We may update these terms. If a change is material we will give notice in the app or by email before it takes effect. Continuing to use the app after that means you accept the updated terms.

18. General

If a provision is unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it. You may not assign these terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. These terms, together with the Privacy Policy, are the entire agreement between us about the app.
